§ 13.20.140. Violations—Penalties.

  • A.

    A violation by a person of any provisions of this chapter shall:

    1.

    Upon the first conviction thereof, be punishable by a fine not to exceed the sum of one hundred fifty dollars ($150.00);

    2.

    Upon the second conviction thereof, be punishable by a fine not to exceed the sum of three hundred dollars ($300.00);

    3.

    Upon the third or further conviction thereof, be punishable by a fine not to exceed the sum of three hundred dollars ($300.00), or by imprisonment for a period not to exceed thirty (30) days, or both.

    B.

    Each day's violation of any provision of this chapter shall constitute a separate offense, punishable as set forth in this section.

    C.

    The franchisee may also enforce the provisions of this chapter by civil remedies as necessary to obtain compliance with this chapter.

    D.

    One or more violations of one or more provisions of Section 13.20.090(J) or 13.20.090(K) or both is/are subject to injunctive relief, actual damages, nominal damages, or any combination of these.
