§ 8.12.240. Solid waste.

  • A.

    Policy. It is declared policy of the city, in the furtherance of the protection of the public health, safety and welfare of the people of the city, to regulate the accumulation of solid waste on public and private property as a public nuisance. Such accumulations are hereby declared to be a public nuisance.

    B.

    Exemptions. Unless specifically provided otherwise, this section does not apply to:

    1.

    Disposal sites approved by the city and operated in compliance with regulations promulgated by the environmental quality commission, the department of environmental quality and other ordinances or regulations of the city.

    2.

    Agricultural operations, including the growing and harvesting of crops and timber, the raising of fowl or animals, and the storage or use of agricultural waste, sprays and fertilizer, provided that operations comply with all applicable laws and regulations. This exception does not apply in land use zones within the city that do not permit such activities.

    3.

    The operation of a junkyard with a valid and current license or permit to operate a junkyard under applicable provisions contained in ORS 377 in an area zoned and/or permitted for use as a junkyard.

    4.

    The operation of a wrecking yard with a valid and current license or permit to operate a wrecking yard under applicable provisions contained in ORS 822 in an area zoned and/or permitted for use as a junkyard.

    5.

    Compost piles used only for the decomposition of garden and yard trimmings and located on the tax lot where the garden and yard trimmings were generated.

    C.

    Solid Waste Accumulation Prohibited. No person shall accumulate, store, collect, maintain or display, on private property, solid waste that: (1) is offensive or hazardous to the health and safety of the public; (2) create odors that are offensive to the extent that a reasonable person is denied their right to quiet enjoyment of their property; or (3) creates a condition of unsightliness.

    D.

    Unauthorized Dumping. Except as provided by subsection B, no person shall dispose of solid waste at any place within the city limits of the city. No person shall use or permit to be used and land within the city as a public or private disposal site without securing all necessary permits and approvals.

    E.

    Disposal of Waste. It will be the responsibility of all persons producing solid waste within the city to dispose of their waste in an approved method.
